Advice from our Legal Services team
Members are receiving letters in various forms requiring them to inform employers whether they are personally taking strike action on 30 November. Whilst this is not in itself an unlawful act by employers, the legal obligation to inform an employer that UNISON members will be taking strike action rests with the union. Employers receive notice of the number of members in their workplace who are being called on to take industrial action. Individual members are not obliged to tell their employer whether they intend to strike and members can be informed of this by the union to reassure them . However it would be sensible for Branches and regions to be intervening and discussing these matters with employers at an early point.
